Up to this day, there is still an ongoing debate on whether to ban this drug or not.
At some state such as the United Kingdom, Denmark, and Netherland, it is illegal for someone to sell and have this drug. Anyone who is caught buying or selling this product will automatically be in jail and a particular penalty depending on the state awaits them. However, this kind of situation is different from the United States. There is still an ongoing debate on whether to ban this drug on their country or not. In Louisiana, their governor have already put a ban regarding on the possession and selling of not just this drug but other research drug such as mephedrone and MDPV as well. This is due to some claim that there has been an increasing accident recorded in the state due to the use of this drug. Aside from Louisiana, North Dakota and Kentucky also make a ban regarding on the use of this drug.

Personal injury law is one of the most important branches of law in the United States. Every city in every state has a number of lawyers who practice in this particular branch of law. Humanitarian Reinstatement Of I-130 Petitions

Question: My mother who is a lawful permanent resident of the U.S, petitioned both my brother and sister who are living in the Philippines eight years ago. We received a notice recently from the National Visa Center stating that we have to pay the Affidavit of Support, (AOS) fees which are something like $800. I was ready to pay this amount when suddenly my mother died. I was told that this may affect the petitions of my siblings. Is this true?

What can I do? Should I pay the $800 to the NVC? What happens to the petitions now that my mother died? Can I be substituted as a sponsor for them instead? One Attorney in Los Angeles said that he can fix this case but he wants $20,000. What should I do?

Answer: Though we always think that once a petition has been filed for us by our relatives in the US, there are only very minor roadblocks we can expect along the way. This is the case most especially if the petition has approved and has been forwarded to the National Visa Center waiting for priority date. Nothing else should worry us and we can just go on living while the priority date becomes current. Or so we think.

Unfortunately, there are cases wherein the petitioner dies before his relatives can come to the U.S. This is often due to the fact that US immigration process has a huge backlog in most countries and that it takes years before a visa becomes available for an applicant. During this long wait, if the Petitioner dies, the petition by law is automatically invalidated and cancelled. A lot of beneficiaries of US immigration petitions, like you, are saddened and surprised that the petition for their loved ones is no longer valid once the petitioner dies. So, if the petitioner dies before the beneficiaries enter the U.S. as immigrants, the case is over.

There is NO need to pay the NVC any fees because 1) the fees will not be refunded, 2)the U.S. Embassy will no longer process the application once it learns that the Petitioner died. The Embassy will instead, send the petition back to the USCIS office that originally approved it back in the states.

In most cases, that is the end of the line. The beneficiaries, even though they waited patiently for years and years can no longer come to the U.S. You cannot step into the shoes of the petitioner and be a substitute sponsor. However, there is a way to appeal this revocation of the petition. The process is called a Request for Humanitarian Reinstatement or also called Request for Humanitarian Revalidation. Humanitarian Reinstatement was made available by immigration regulations to cover these kinds of situations. It is entirely discretionary with the USCIS and is not guaranteed, but if you can show that there are circumstances justifying the reinstatement of the petition, the USCIS can revalidate and approve the petition and the beneficiaries can come to the U.S. as if the petitioner were still alive. The USCIS usually looks at the following factors: 1) disruption of an established family unit; (2) hardship to U.S. citizen or LPR family; (3) age and health of beneficiary; (4) length of beneficiarys residence if any in the United States; (5) whether beneficiary has a foreign residence (if in the U.S.) to which he can return; (6) undue delay by USCIS or the embassy in processing the petition or visa; and (7) extent of beneficiarys family ties in the United States.

For a Humanitarian Reinstatement to be applicable, the petition must have first been approved before the death the petitioner. Secondly, the beneficiary must arrange to have a substitute sponsor who may file for the required affidavit of support. This must be someone who can establish the means to support the beneficiaries with an annual income amount equal to at least 125 percent of the Federal Poverty line.

The qualified substitute sponsor must be a close relative such as the spouse, parent, mother-in-law, father-in-law, sibling, child (if at least 18 years of age), son, daughter, son-in-law, daughter-in-law, sister-in-law, brother-in-law, grandparent, grandchild of a sponsored alien or a legal guardian of the sponsored alien. Friends and distant relatives cannot qualify.

As far as paying an attorney $20,000 for submitting a request for reinstatement, I would question any lawyer who charges such exorbitant fees. Would you pay $1000 for a $1 lottery ticket without a guarantee of winning? Sure, there is a lot of work involved but there is no need to gouge or take advantage of persons who are suffering the loss of a loved one. I, for one, do not practice law that way. I would be weary of anyone who says it is a sure thing or I guarantee it. By law, reinstatement is discretionary. No one, can say if a request will be approved and it is unethical to claim it is a sure thing. Stay away from such boastful claims. You will be $20,000 richer and a lot happier.

For immigration purposes Marriage fraud is a misleading Union where a man and a woman will get married for the sole purpose of one of them obtaining permanent resident status in the United States or other countries. Many people see this type of marriage as a trade agreement between two people. Asbestos Lawsuits in Louisiana

In towns and cities throughout the United States, asbestos lawsuits are increasingly prolific as individuals exposed to asbestos twenty and thirty years ago are today developing and dying from mesothelioma. Mesothelioma is a rare and extremely lethal form of cancer, in which malignant cells are found in the protective sac covering most of the bodys internal organs. Mesothelioma, which is caused by exposure to asbestos, takes up to three decades to strike its victims. Those with the greatest risk of developing mesothelioma have worked on jobs where they inhaled asbestos particles, or have been exposed to asbestos dust and fiber in other ways.

Today, a growing number of mesothelioma lawsuits have succeeded in recovering hundreds of millions in compensation for the tens of thousands of mesothelioma victims. Compensation is paid by the companies that make these asbestos products, and enables victims to cover their medical expenses and to be compensated for their pain and suffering.

A current center of concern for asbestos victims is New Orleans. In the post-Katrina era, New Orleans and the entire state of Louisiana is undergoing a boom in construction a business infamous for its use of asbestos products. Post-storm rehabilitations of homes, the related large-scale demolitions, and even just the ubiquitous roofing jobs currently underway are exposing thousands of people to asbestos. Despite these dangers, however, Congress is considering a Bill that would prevent someone who becomes ill with cancer as a result of post-Katrina asbestos exposure from getting financial relief.

The introduction of the Bill is being motivated by calls for tort reform among asbestos-related industries. Financially crippled by increasingly high rewards to asbestos victims, these industries want a cap on their liability. They cite a recent asbestos lawsuit in Louisiana, in which homeowners who purchased asbestos-contaminated fill dirt sued the contractor who sold them the soil, as well as the oil company where the dirt had been removed. Although none of the plaintiffs have yet become sick, a jury awarded them compensatory and punitive damages due to their fear of harm (rather than actual harm). The verdict was upheld by a Louisiana appeals court, which ruled that any exposure to a harmful substance, no matter how slight, justifies a lawsuit.

The new Bill, set for debate by Congress in February, would halt asbestos lawsuits. The Bill is seeking to protect companies with asbestos liability from further lawsuits by paying into a government administered trust fund, which would screen claimants through established medical criteria. Victims would be awarded compensation based on the severity of their illness. The Bill specifically states that the fund would not cover victims of environmental and neighborhood exposure, with the prime example being post-Katrina victims in New Orleans and across Louisiana. The Bill is widely opposed by the medical community, as well as by labor unions and citizens rights activists, particularly in the state of Louisiana.

Legal Copyright Eligibility For Copyright Protection

There are many laws that protect people in the world. Some of these laws are meant to protect rights covered under the Bill of Rights, and other rights are meant to protect the things we create. The eligibility for copyright protection is extended to anyone who is able to create something that is tangible.

There are international laws that provide copyright protection, and the laws for people living in the United States are covered under the doctrine of 17 USCA Section 102(a). The eligibility for copyright protection is clearly outlined in this document and business owners would fare well to spend a little bit of time reading through this doctrine because it may keep someone else from stealing the royalties of your work.

The eligibility for copyright protection extends to any tangible thought that is applied to paper. If it is still in your mind or in the development process where the idea has not been put down on paper or some other solid form, then the eligibility for copyright protection will not apply to it. Some people expect this to apply and are sorely disappointed when they are turned down at the copyright registration office.

If you want to create a novel or other literary work, then it would qualify for eligibility for copyright protection. Perhaps you are a photographer or a tourist who captured an exquisite photo of an event that is a once-in-a-life time experience. Since you placed yourself at great risk taking the photograph, you want to register the photo and copyright it so that other people can not make money from it without your approval. That photograph falls under the eligibility for copyright protection.

If you wanted to create a description of the photograph, then that description would qualify for eligibility for copyright protection as long as it is written down. The information can be stored on any means that you like such as compact disk, a computer or included as a caption underneath the picture and framed. All methods used to create the description fall under the eligibility for copyright protection.

Although a sculpture would not be considered a written work, it is still a method of expression that has a solid and tangible form to it. The sculpture falls under the auspices of eligibility for copyright protection. No further documentation is really necessary. It is real and can be held. Therefore, it is protected by copyright from the second it is created. That fact should spur the creative juices in many people who were unaware of what is covered under copyright protection.

If you have only an idea to reflect on, then that idea does not fall under the auspices of eligibility for copyright protection. The idea might be covered under a confidentiality agreement if you hire someone to take your idea and develop a product description from it, or content for your business website. When the idea becomes a mode for expression, then it maintains eligibility for copyright protection.

How To Select Personal Injury Lawyer

If you suffered in a personal injury accident that because of someone else’s fault, you should consult with a lawyer to make a claim and get the compensation you deserved.

However, insurance companies will try all their best to take advantage of you if you should decide to sue, so it is not wise for you to personally meet the insurance company without your lawyer present. An experienced personal injury lawyer will know how to successfully negotiate with the insurance company and handle your case.

Anyway, it is really a time consuming and challenging task to select a proper lawyer for yourself. Here are some important qualities for your reference when selecting your lawyer.

Experience – The most important thing you should think about is the lawyer’s experience. You will never want to hire a green hand in your case. The more case like yours the lawyer experienced, the more successfully your case would be handled. A good lawyer is the one who experienced so many such cases and will know what to do immediately without researching your case or check court decisions. This will save you a lot of time and energy.

Specialization – You should try to find a lawyer who is specializing in handling cases like yours. Experiences are very important but they should be related to your case. Thus, the lawyer will be familiar with your case and he/she will have a well-thought-out plan about how your case should handled, which will largely enhance the chance for your case to be successful. For example, if you were injured in a slip and fall accident, you wouldn’t want a lawyer who is majored in real estate.

Reputation – You should also take the lawyer’s reputation into consideration when trying to find one. The more successful similar cases he/she has handled, the more possible for your case to win. So if a family member or friend can recommend a lawyer that has good work experiences in cases similar to yours, then it is advisable for you to make the appointment to meet the lawyer. Besides, if the lawyer is a member of American Association for Justice (AAJ), that previously was known as the Association of Trial Lawyers of America (ATLA), which is the biggest association for personal injury lawyers in the United States, then he/she must have a higher reputation than others.

These tips are just some guidelines for you to select a qualified personal injury lawyer. Remember, the step of selecting your lawyer may be crucial to your case result.

Get An Idea Of The Different Qualities Of A Good Personal Injury Attorney

Personal injuries may happen anytime and anyplace. However, it is seen, in many cases that people tend to overlook the importance of hiring a personal injury attorney to deal with such mishaps. In most parts of the United States, like Sarasota (FL) and Fruitville (FL), you would come across a number of such lawyers. However, it is important to know that not all are equally experienced to deal with every aspect of such legal matters pertaining to personal injury.

Most of the American citizens, especially those residing in some of the major US cities, like Sarasota (FL) and Englewood (FL), who have interacted with a personal injury attorney recently, would tell you that it is always a good idea to spend some time to find the best lawyer. However, since after such mishaps nobody would have the time to search for a good lawyer, it is better to keep the contact details of a few of them beforehand. Here are some qualities of a good personal injury attorney, which in turn would help you recognize him amongst others:

1.Open for discussion anytime of the day: A good lawyer, who deals in such legal matters, would be ready to help you and also discuss the situation with you anytime of the day. These types of accidents do not announce beforehand of their happening. So it is very important for a good lawyer to be always prepared to help his clients.

2.Willing to keep you updated: One of the great qualities of a good personal injury attorney is that he would never shy away from keeping his clients updated about the happenings of the case in a court of law. If the lawyer refuses to do this basic service, then all his clients would remain in the dark about what is happening to their cases. This in turn would hamper the popularity of the legal adviser and all his future clients would think twice before approaching him for help.

Whatever be the situation, it is always considered to be a good idea to take your time and look for a good and experienced personal injury attorney. Sarasota (FL) and Laurel (FL) are some of those places in the US where you would find a number of people who have kept the contact details of such legal advisers handy. This is good since you never know when you may need one to help you during times of distress.
